These Terms of Service ("Terms") govern your access to and use of the HotDealsNearby.com website, platform, and related free services ("Platform") provided by HotDealsNearby.com LLC ("Company," "we," "us," or "our"). By accessing, browsing, registering for an account, posting any content, or using the Platform in any way, you agree to be legally bound by these Terms. If you do not agree, you must immediately stop using the Platform.
These Terms apply to free use of the Platform (browsing deals, posting basic free listings, account registration, etc.). Paid advertising, featured spots, boosted placement, managed services, analytics, and any other paid features are governed by our separate Business Services Terms & Conditions, available at here, which are incorporated by reference. In case of conflict, the Business Services Terms control for paid features.
You must be at least 18 years old to use the Platform. By using the Platform you represent and warrant that:
We have designed this Platform primarily for adults and business owners. If we discover a user is under 18, we will terminate their account immediately. If you are a parent or guardian and believe a minor has registered, please contact us at support@hotdealsnearby.com.
When you create an account, you will be asked to confirm acceptance of these Terms. By creating an account or continuing to use the Platform, you agree to be bound by them.
You may create an account using Google or Apple OAuth or other methods we make available. You agree to:
We are not responsible for any loss or damage from your failure to secure your account. Accounts with false or misleading information may be suspended or terminated immediately without notice.
One account per user or business. Creating multiple accounts to circumvent restrictions, gain additional free listings, or for any other purpose is prohibited and grounds for immediate termination of all associated accounts.
Anyone — including customers and members of the public — may post deals and listings. We do not verify the accuracy, completeness, currency, or legitimacy of any content posted on the Platform. All content is user-submitted and may not reflect actual current offerings, availability, prices, or policies. Use all content at your own risk.
You are solely responsible for all content you post ("Content"). All Content must be lawful and comply with these standards.
Prohibited Content. You may not post Content that:
FTC Disclosure. If your Content constitutes a paid promotion, advertisement, sponsored post, or involves any affiliate or financial relationship, you must clearly and conspicuously disclose that relationship within the Content itself, in compliance with FTC guidelines.
Moderation. We may review, edit, reject, or remove any Content at our sole discretion, with or without notice. For non-serious, first-time violations, we will generally attempt to notify you and allow 48 hours to cure before removal. We reserve the right to remove immediately for illegal, fraudulent, high-risk, or infringing Content.
Content License. By posting Content, you grant HotDealsNearby.com LLC a non-exclusive, royalty-free, worldwide, perpetual license to display, reproduce, distribute, and promote that Content on the Platform and in our marketing materials for the duration of your use and for up to 30 days following removal or termination (for archival and legal purposes). This license survives deletion of your Content or termination of your account.
You represent and warrant that (a) you own or have all necessary rights to post the Content and grant this license; (b) your Content does not infringe any third-party rights; and (c) your Content complies with these Terms.
Business Removal Requests. If you are a business owner and want a listing about your business removed, contact us at support@hotdealsnearby.com. We will review and, at our sole discretion, remove listings that contain false, misleading, or harmful information. We make no guarantee of removal timing or outcome and are not obligated to remove accurate, lawful content.
You agree not to:
"As Is" / "As Available." The Platform is provided "as is" and "as available" with no warranties of any kind. We make no representations about the suitability, accuracy, or availability of the Platform for any purpose.
We do not verify, endorse, or guarantee the accuracy, completeness, currency, legitimacy, or availability of any deal, listing, business, price, promotion, or other content on the Platform, whether posted by a business owner, a customer, or any third party. Any deal or listing may be inaccurate, expired, or unavailable. You assume all risk in relying on any content.
We do not guarantee continuous, error-free, or uninterrupted access to the Platform, any specific views, leads, clicks, customers, or business results, or accurate geolocation or search functionality.
Free listings are provided as a courtesy. We make no guarantee of placement, visibility, traffic, or results. Free listings may be ranked below paid placements at all times.
We are not a party to any transaction or dispute between users and businesses. Any dispute arising from a business's products, services, deals, prices, or conduct is solely between you and that business.
Evidence Standards. In any dispute arising under these Terms, Company's internal records, server logs, and database records are the authoritative source of truth. User-submitted screenshots or documents without independently verifiable metadata or timestamps are supplemental evidence only and are not sufficient on their own to establish a claim or override Company records.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR FREE USE OF THE PLATFORM IS ZERO DOLLARS ($0). THE PLATFORM IS A FREE SERVICE PROVIDED AS A COURTESY; YOU PAY NO CONSIDERATION AND ACCORDINGLY NO DAMAGES ARISE FROM ITS USE OR UNAVAILABILITY.
IN NO EVENT SHALL HOTDEALSNEARBY.COM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST CUSTOMERS, LOST BUSINESS OPPORTUNITIES, DATA LOSS, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS EXCLUSION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH SUCH DAMAGES ARE CLAIMED.
For claims arising from paid services, liability is governed exclusively by the Business Services Terms & Conditions.
You agree to indemnify, defend (with counsel reasonably acceptable to Company), and hold harmless HotDealsNearby.com LLC and its officers, managers, members, employees, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, penalties, fines, judgments, and reasonable attorney fees and costs arising from or related to:
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe Content on the Platform infringes your copyright, please submit a written DMCA notice to support@hotdealsnearby.com containing the information required under 17 U.S.C. § 512.
Our designated DMCA agent must is registered with the U.S. Copyright Office (copyright.gov/dmca-directory) for full safe harbor protection.
We may suspend or terminate your access at any time, with or without notice, for any reason. For non-serious violations, we will generally attempt to provide written notice before or at the time of termination. However, notice is not required and failure to provide notice does not create any claim against Company.
Upon termination, your right to use the Platform ends immediately.
Surviving Obligations. The following sections survive termination for any reason: Section 3 (Content License and representations), Section 4 (Prohibited Conduct — competitive use), Section 5 (Disclaimers), Section 6 (Limitation of Liability), Section 7 (Indemnification), Section 8 (DMCA), Section 10 (Dispute Resolution), Section 11 (Force Majeure), Section 13 (Miscellaneous), and any indemnification or payment obligations accrued prior to termination. Any obligation that by its nature should survive termination will do so regardless of whether expressly listed here.
These Terms are governed by the laws of the State of Kentucky, without regard to conflict-of-laws principles.
Paid Service Disputes. For disputes arising from paid services, the dispute resolution provisions in the Business Services Terms & Conditions govern exclusively.
Free Platform Disputes. Before filing any lawsuit arising from free use of the Platform, the complaining party must provide written notice to the other party describing the dispute in reasonable detail and the relief requested. The parties must then engage in good-faith efforts to resolve the dispute for at least thirty (30) days. Notices to Company must be sent to support@hotdealsnearby.com. Failure to complete this step is grounds for dismissal of any filing.
Any dispute not resolved through informal resolution shall be brought exclusively in the state or federal courts located in Kenton County, Kentucky. You consent to personal jurisdiction and venue there and waive any objection.
Class Action Waiver. You waive any right to bring or participate in any class action, collective action, private attorney general action, or representative proceeding against HotDealsNearby.com, whether arising from free or paid use of the Platform. All disputes must be brought on an individual basis only.
We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government actions, DDoS attacks or cyberattacks, internet or telecommunications failures, third-party service provider outages (including hosting or infrastructure providers), or power outages. During any such event, our obligations are suspended for the duration. No liability, credit, or remedy of any kind is available to free users for Platform unavailability caused by force majeure events.
We may update these Terms at any time. For material changes, we will make reasonable efforts to notify registered users via email or platform notification before the changes take effect. Non-material updates may take effect immediately. Continued use of the Platform after any update constitutes your acceptance of the updated Terms.
It is your sole responsibility to review these Terms periodically and to maintain a valid email address on your account. Failure to receive notice due to an invalid or undeliverable email address does not invalidate updated Terms or provide grounds for objection.
No Waiver. No failure or delay by Company in exercising any right under these Terms constitutes a waiver of that right. A waiver must be in writing and signed by an authorized representative of Company to be effective.
Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to be enforceable. The remainder continues in full force and effect.
Entire Agreement. These Terms, together with the Business Services Terms & Conditions (for paid features) and the Privacy Policy at https://www.hotdealsnearby.com/privacy-policy, constitute the entire agreement between you and the Company regarding your use of the Platform. No oral statement, email, or marketing material creates binding obligations outside these documents.
Relationship of Parties. Nothing in these Terms creates an employment, partnership, joint venture, agency, or franchise relationship between you and Company.
Assignment. You may not assign, transfer, or delegate your account or any rights under these Terms without our prior written consent. Any attempted assignment is void. Company may assign these Terms or any rights hereunder at any time without notice to you.
